These Terms and Conditions govern your use of the Proactive Approach website and any services we provide, including administrative support, operational assistance, and related services. By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
Our Services
Proactive Approach provides flexible administrative and operational support for clubs, small organisations, and busy individuals. The specific scope of any project or ongoing arrangement will be agreed in writing before work begins, either through a formal proposal, email confirmation, or statement of work.
Quotes and Payment
All quotes are provided on an individual basis and are valid for 30 days unless otherwise stated. Prices are exclusive of VAT unless specified. Payment terms will be outlined in your project proposal. For larger projects, we may require a deposit before work begins, with the balance due on completion or in agreed instalments. Late payments may incur additional charges and we reserve the right to suspend services until outstanding balances are settled.
Service Delivery
We will work with you to agree on the scope, timeline, and deliverables for your project or ongoing support arrangement. We rely on you to provide relevant information, access, and approvals in a timely manner. Delays in providing materials or feedback may affect the service timeline. Any changes to the agreed scope may result in additional charges, which we will discuss with you before proceeding.
Confidentiality
We understand that our clients may share sensitive information with us in the course of our work. We treat all client information as confidential and will not share it with third parties without your express consent, except where required by law.
Your Responsibilities
You are responsible for providing accurate and lawful information for us to carry out our work, ensuring you have the rights to use any materials you supply to us, and keeping any shared account credentials secure. You agree not to use our services for any unlawful purpose.
Limitation of Liability
Our services are provided in good faith and to a professional standard. However, to the maximum extent permitted by law, Proactive Approach shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of revenue, data, or business opportunities. Our total liability for any claim shall not exceed the total fees paid by you for the specific service giving rise to the claim.
Termination
Either party may terminate a project or ongoing service with 30 days written notice. If you terminate a project before completion, you will be invoiced for all work completed to date. We reserve the right to terminate services immediately if you breach these terms, fail to make payments when due, or use our services in a way that could cause harm to others.
Cancellation and Refunds
Deposits are non-refundable once work has begun. If we are unable to deliver the agreed services, we will refund any payments for work not yet completed.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms
We may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
